Acceptance of Terms
By accessing or using Fillr ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. We may update these terms from time to time, and continued use constitutes acceptance of the updated terms.
Description of Service
Fillr is a drag-and-drop form builder that lets you create, customize, and embed forms into any website via a native Web Component. The Service includes the builder interface, form hosting, submission storage, and submission management tools. Fillr acts as a data processor for form submissions collected through your forms.
User Accounts
To use Fillr, you must create an account. Here's what you agree to:
- You must provide accurate and complete account information (email address and optional display name).
- You are responsible for maintaining the security of your account credentials. Fillr uses the SRP protocol so your password is never sent to our servers in plaintext, but you are still responsible for keeping your login credentials confidential.
- You may delete your account at any time by contacting us at hello@fillr.cloud or through the dashboard. Upon deletion, your account information and all associated data will be permanently removed.
Subscriptions & Billing
- Fillr offers several plans: Free, Starter, Pro, and Enterprise. Each plan has different features, limits, and data retention periods as described on our pricing page.
- All payments are processed by Stripe. Fillr never sees or stores your payment card details. Your billing information is subject to Stripe's Privacy Policy and Terms of Service.
- You may cancel your subscription at any time. Upon cancellation, your account will be downgraded to the Free plan at the end of the current billing period. Your data will be subject to the Free plan's retention limits.
- Refunds are handled on a case-by-case basis. Contact hello@fillr.cloud for refund requests.
User Responsibilities
As a Fillr user, you agree to:
- You are the data controller for all data collected through your forms. Fillr is your data processor. You are responsible for complying with all applicable data protection laws, including GDPR, CCPA, and others relevant to your jurisdiction.
- You must obtain any necessary consents from form respondents, including parental consent if you collect data from individuals under 13.
- You must provide your own Privacy Policy to form respondents that discloses how you collect, use, and process their data through Fillr.
- You must not use Fillr for any illegal purpose or in violation of any applicable laws or regulations.
- You must not use Fillr to collect data from children under 13 without appropriate parental consent. Fillr is not intended for use by children under 13.
Data Processing
Fillr processes personal data as a data processor on behalf of the form creator (the data controller). The data controller retains full ownership and control over the data collected through their forms. A Data Processing Agreement (DPA) is available upon request — contact hello@fillr.cloud. The DPA incorporates the Standard Contractual Clauses for international data transfers as needed.
Intellectual Property
- Fillr's software, branding, and underlying technology are owned by Fillr. You may not copy, modify, reverse engineer, or distribute them except as explicitly permitted.
- You retain all intellectual property rights to the forms you create and the data you collect through Fillr.
- Any feedback or suggestions you provide about the Service may be used by Fillr without obligation to you.
Acceptable Use
You agree not to use Fillr for:
- Sending unsolicited messages, surveys, or spam through the platform.
- Distributing malware, viruses, or other harmful code through forms or file uploads.
- Harassment, stalking, or any form of abuse toward form respondents.
- Fraudulent or deceptive activities, including phishing or identity theft.
- Promoting hate speech, violence, or discrimination.
- Interfering with or disrupting the integrity or performance of Fillr's infrastructure.
Limitation of Liability
Fillr is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Fillr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. In no event shall Fillr's total liability exceed the amount you have paid us in the 12 months preceding the claim.
Termination
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy and applicable data retention periods. We will provide a reasonable period for data export if requested.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
Changes to Terms
We may revise these Terms from time to time. Material changes will be notified via email or through the dashboard. Continued use after changes take effect constitutes your acceptance of the new Terms.
